Simple Assault Charges 

O.C.G.A. § 16-5-20 defines simple assault as an attempt to use violence or make threats of violence against an individual that convinces a person to fear for their safety genuinely. Simple assault is charged as a misdemeanor in Georgia and carries a sentence of no more than one year in jail, fines of up to $1000, and community service.

Aggravated Assault Charges

The definition of aggravated assault – GA Code § 16-5-21 –  is “an offense in which a person commits assault by:

  • Assault with the intention to murder, rape, or rob
  • Using a deadly weapon or any object likely to cause serious injury against another individual
  • Discharging a firearm from within a motor vehicle or after immediately exiting a vehicle towards a person, occupied motor vehicle, or occupied building

Aggravated assault charges carry sentences of up to 20 years in jail, depending on the context. While aggravated assault charges stemming from an assault on a public safety officer, or senior citizen, or from an assault within a school safety zone carry the heaviest penalties.
