O.C.G.A. § 16-5-20 defines simple assault as an attempt to use violence or make threats of violence against an individual that convinces a person to fear for their safety genuinely. Simple assault is charged as a misdemeanor in Georgia and carries a sentence of no more than one year in jail, fines of up to $1000, and community service.
Aggravated Assault Charges
The definition of aggravated assault – GA Code § 16-5-21 – is “an offense in which a person commits assault by:
- Assault with the intention to murder, rape, or rob
- Using a deadly weapon or any object likely to cause serious injury against another individual
- Discharging a firearm from within a motor vehicle or after immediately exiting a vehicle towards a person, occupied motor vehicle, or occupied building
